Introduction of the new Federal Registration Act from 01.11.2015

The new Federal Registration Act (BMG) will be introduced with effect from 01.11.2015. The new Federal Registration Act also introduces a new confirmation of accommodation provider. This means that the landlord has an obligation to cooperate in registration procedures according to § 19 of the Federal Registration Act. When registering their place of residence, persons subject to the obligation to register must present an identity card or passport or passport replacement document as well as the confirmation of accommodation provider. This means that in future a confirmation from the landlord must be issued each time the person moves in and in some cases also when moving out (e.g. when moving abroad, abandonment of a secondary residence without replacement).

The confirmation must contain the following data: Name and address of the housing provider, move-in date, address of the apartment and names of the persons who are obliged to register. The presentation of a rental agreement does not replace the confirmation of move-in.
