Federal Ministry of the Interior considers the Berlin ‘rent freeze’ (Mietendeckel) as unconstitutional

The planned ‘Mietendeckel’ in the Capital does not only unsettle Berlins landlords, even the legal experts of the Federal Ministry of the Interior classify the proposed bill as unconstitutional.

The Federal Interior Ministry comes to the assessment that the state of Berlin does not have the legal competence for such a regulation.
In addition, the bill affects the ownership of the apartment owners and covers all landlords without distinction and does not take into account rising prices of maintenance.

The red-red-green coalition don’t care and wants the ‘rent freeze’ law by the beginning of 2020. This law will freezes rents for five years, sets rent limits for new leases and even provides for rent reductions.
